The Social Security Administration pays benefits to people who are not able work because they have a mental and/or physical medical condition(s) that is expected to last at least one year or result in death. Federal law requires this very strict definition of disability. For you to be considered disabled by Social Security’s definition, your mental and/or physical medical condition must significantly limit your ability to do basic work activities, such as lifting, standing, walking, sitting, and sustaining concentration. If your medical condition is not severe, you would not be considered disabled.

The Social Security Administration offers disability benefits through two programs: Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI). SSDI is based on quarters of coverage or credits earned from your work history and SSI is a need-based program. In order to qualify for benefits under either program, you must be found disabled by the Social Security Administration.

If you were denied for disability benefits at the initial level or upon reconsideration, you can appeal this decision and request a hearing before an Administrative Law Judge. Approximately two thirds of Social Security disability claims are denied at the initial level. If you still believe you are disabled and you have not returned to work, you should consider filing a Request for Reconsideration or an appeal before an Administrative Law Judge (ALJ). If you received an unfavorable decision from the ALJ, you can appeal that decision to the Appeals Council.
